Need A Phone Protection Plan — Terms & Conditions
Please read these Terms & Conditions together with your order confirmation. By purchasing the Need A Phone Protection Plan, you agree to these terms.
1. Definitions
- “We”, “Us”, “Our” means Need A Phone Inc., the provider and obligor of this Protection Plan, located at [BUSINESS ADDRESS], Winnipeg, Manitoba. You can reach us at [PHONE] or hello@need-a-phone.ca.
- “You”, “Your” means the individual or entity who purchased this Protection Plan.
- “Protection Plan” means the Need A Phone Protection Plan described here. It is a service contract — it is not insurance and is not underwritten by any third party.
- “Covered Product” means the single device shown on your order for which the Protection Plan was purchased.
- “Date of Purchase” means the date you purchased the Protection Plan; “Coverage Start Date” means the date you received the Covered Product.
- “Coverage Term” means one (1) year from the Coverage Start Date.
- “Deductible” means the amount you pay per claim, as set out in Section 4.
- “Coverage Amount” means the replacement value of the Covered Product, less any applicable Deductible.
2. What the Plan covers
During the Coverage Term, and during normal use, this Protection Plan covers the parts and labour needed to repair or replace the Covered Product for:
- Mechanical and electrical failures, and functionality issues (including buttons, connectivity ports, speakers, microphones, cameras, and Wi-Fi / Bluetooth / cellular faults);
- Accidental damage, including cracked or damaged display screens, drops, and liquid or water damage;
- A defective or degraded battery — if the battery’s maximum capacity falls below 80% of its rated health during the Coverage Term, we will replace it at no charge beyond your Deductible; a battery replacement counts as your one repair or replacement claim;
- Defective pixels, dust, internal overheating, internal humidity/condensation, and defects in materials or workmanship.
Replacement parts may be new, rebuilt, or non-original-manufacturer parts that perform to the device’s factory specifications, at our reasonable option. This Protection Plan is provided in addition to, and does not replace, any manufacturer’s warranty or your legal warranty rights.
3. Claim limit and how we resolve claims
You may make one (1) claim — a single repair or replacement — during the Coverage Term. For that claim, at our reasonable discretion we will either: (A) repair the Covered Product; or (B) replace it with a product of like kind, quality and functionality; or (C) provide a settlement reflecting the replacement cost of a comparable device, up to the Coverage Amount. If we cannot repair the device, we will replace it. Once we have completed your claim, our obligations under this Protection Plan are fulfilled. Other than your Deductible, there are no additional charges to you for covered parts, labour, or shipping.
4. Deductibles
Your claim is subject to a Deductible, collected at the time of the claim. Because repair parts cost more on higher-value devices, the Deductible scales with the pre-tax price you paid for the Covered Product:

5. What the Plan does NOT cover
- Loss, theft, or devices that are irretrievable;
- Any replacement device or component provided under a claim;
- Pre-existing conditions arising before the Coverage Start Date;
- Intentional damage, abuse, misuse, or operator negligence;
- Cosmetic damage (scratches, scuffs, dents) that does not affect functionality;
- Devices with a removed, altered, or unreadable serial number or IMEI, or any device reported lost/stolen, blacklisted, or failing CWTA verification;
- Damage from causes outside normal use — e.g. fire, flood, or other acts of nature originating outside the product;
- Failures covered at no cost by a valid manufacturer’s warranty or recall;
- Data loss, lost time, or any consequential loss; “no problem found” diagnoses; and issues that are not product failures (such as poor cellular reception).
6. Coverage term and start date
Coverage begins on the Coverage Start Date and continues for one (1) year. The Protection Plan must be purchased at the same time as the Covered Product [or within [X] days of delivery — confirm].
7. Non-transferable
This Protection Plan applies only to the original purchaser and the original Covered Product. It is not transferable to another person or to another device.
8. Cancellation and refund
- You may cancel within 30 days of purchase for a full refund, provided no claim has been made.
- Quebec residents may cancel within 10 days of purchase under the Quebec Consumer Protection Act (see Section 10).
- After the applicable window, you may still cancel for a pro-rata refund of the unused portion.
- We may cancel this Protection Plan for non-payment, fraud, or material misrepresentation, with a pro-rata refund where applicable.
9. Limit of liability
The total amount we will pay across your claim will not exceed the Coverage Amount of the Covered Product. Once we have repaired or replaced the device, or provided a settlement equal to the Coverage Amount, we have no further obligation. To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages, including property damage, lost time, or lost data. Nothing in these terms limits rights that cannot be limited under applicable Canadian consumer-protection law.
10. Your legal rights (Quebec)
Regardless of this Protection Plan, you already benefit — free of charge — from the legal warranty under the Quebec Consumer Protection Act (ss. 37–38) and the Civil Code of Québec (art. 1726): the device must be fit for its intended use and durable for a reasonable time given its price and normal use. This Protection Plan is offered in addition to, and does not replace, that free legal warranty or our standard 90-day warranty.
11. Governing law
These terms are governed by the laws of the Province of Manitoba and the applicable federal laws of Canada. If any provision is found unenforceable, the remaining provisions stay in effect.
